Notice of Decision The City of Pateros is hereby providing a notice of decision by the City Council to approve the fence height variance requested by Gary Gogal, dba Chelan Valley Construction LLC, owner of the subject property to allow a newly constructed fence within what is technically the front yard at 106 Ives St. to remain at 6’ in height versus the 3.5’ set forth in 17.04.090 of the Pateros Municipal Code. The Council approved the variance subject to the following conditions: 1) That any failure of the retaining wall that requires repair will require the fence to be reduced in height to 3.5’; and, 2) That if any failure or significant maintenance or replacement of the fence is required, the fence shall be reduced to 3.5’ in height. Persons with standing that wish to appeal the Council’s decision have until May 3, 2024 to file a Land Use Petition Act appeal in Okanogan Superior Court.
